Fatal accident in Georgia has unknown cause

Losing a loved one is a very difficult part of life. When we lose a loved one unexpectedly, many questions often surround their death. What happened? Who is responsible? Could the loss have been prevented? When these questions surround a family, it is sometimes best to explore their options and understand their rights

A recent accident in Clayton County occurred near the intersection of Ga. 85 and Ga. 135. There, two vehicles collided head on. The driver of one vehicle was airlifted to a local hospital. The passenger of the second vehicle was killed at the scene. Investigation is still underway and the police are unsure as to the cause of the accident at this time.

In a wrongful death lawsuit, it is important to further investigation in order to uncover the cause of an individual's death. If that cause happens to be at the fault of another, the family may be entitled to legal relief. Fault can be assigned to another when an individual exhibits negligence. Negligence occurs when someone fails to uphold a reasonable duty. Examples of negligent behavior may include texting and driving or driving while intoxicated.

Families able to demonstrate this negligence are able to pursue a claim through the Georgia court system. This claim may help them gain compensation for the financial burden that has been placed upon them since their loved one's death. Compensation may be awarded for pain and suffering, loss of guidance and future wages and other expenses such as hospital bills and funeral costs.

Families with questions should try their best to uncover the answers. Before pursuing a claim, families should seek to better understand their situation and protect their legal rights.
