Wrongful death lawsuit filed after fatal shooting in Atlanta

| Dec 27, 2013 | Wrongful Death

A fatal shooting at an Atlanta mall has led to a wrongful death lawsuit being filed against the mall and the city of Atlanta. A young man was killed last summer while he was shopping at the Underground Atlanta shopping center.

Law enforcement authorities caught the man responsible for the fatal shooting. Police said the man followed the victim and started shooting at him and his friends when they were leaving the shopping center. The police arrested the man for murder, gun possession and aggravated assault.

After the fatal shooting, the victim’s family filed a wrongful death lawsuit in Fulton County State Court against the mall and city of Atlanta. The lawsuit claims that the mall and city did not provide adequate security that could have prevented the fatal incident that resulted in the death of their son.

The lawsuit also states that there were more than 6,000 crimes in the area reported to the local police so law enforcement knew of the dangerous criminal activities that put customers at risk. The lawsuit claims that the mall also knew about the dangers and failed to keep customers in the mall safe. It also alleges that the mall didn’t properly train security guards, or have security policies or well-positioned security cameras that could have prevented the fatal shooting.

The lawsuit also named several additional management companies and employees as defendants.

This case is an example of the legal action victim’s families can take after a fatal accident or incident in Atlanta. If someone else’s negligence contributes to the death of someone, the victim’s family can pursue a wrongful death lawsuit against those responsible. Wrongful death lawsuits do need to prove negligence or responsibility for the death.

Families thinking about filing a wrongful death lawsuit after a family member has been killed should consult a personal injury attorney to discuss their specific cases.
